So New Mexico has gone back and forth with their reciprocity laws in the last year, and I’m hoping someone who lives in NM or even works at a dispensary can answer my questions.
They started allowing reciprocity if you are a resident of another state and had a medical recommendation from some other state. So for example a Texas resident could get a California doctor to recommend cannabis and they can legally purchase it in New Mexico showing their Texas ID and the California card.
Then the department of health stepped in and said no, your medical recommendation needs to come from your state of residence.
Then they got sued and I think it was overturned but do the dispensaries feel comfortable doing that? I am in the situation described above: I have a Texas driver license but a valid MMJ recommendation from California. Would I be served if I traveled through New Mexico?
